By accessing or using the services provided by 5-2 Funding (“Company,” “we,” “us,” or “our”), including our platform, managed fundraising services, and related tools (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

5-2 Funding provides a fundraising platform combined with managed services, including campaign setup, participant onboarding support, SMS, MMS, and RCS messaging, email communications, Live Event execution, donation tracking and reporting, ongoing campaign monitoring, donor support, and donation reconciliation and disbursement coordination. We may act on behalf of organizations to execute fundraising activities.

You agree to provide accurate and complete information, maintain rights to all data submitted (including contact lists), obtain all required permissions and consents from participants and contacts, and use the Services only for lawful purposes. You are solely responsible for compliance with applicable communication, fundraising, and privacy laws.

SMS, MMS, and RCS Messaging Terms

By using the Services, you represent and warrant that you have obtained prior express consent from individuals before submitting their contact information and that you authorize 5-2 Funding to send SMS, MMS, RCS, email, and related communications on your behalf.

5-2 Funding messaging programs may include:

• Fundraiser registration and onboarding communications
• Participant account setup notifications
• Fundraiser progress updates
• Donation confirmations and donor communications
• Campaign reminders and status updates
• Live Event notifications and reminders
• Organization administrative communications
• Fundraising support communications

Message frequency varies based on fundraiser participation, campaign activity, donor engagement, and account activity.

Message and data rates may apply.

To stop receiving messages, reply STOP to any message. After you send STOP, you may receive a final confirmation message confirming your opt-out request.

Carriers are not liable for any delayed or undelivered messages.

Recipients may opt out at any time. 5-2 Funding is not responsible for consent obtained improperly by organizations, participants, or users of the Services.

If your mobile number changes, please notify us so we can update our records. 5-2 Funding is not responsible for messages sent to a reassigned number if we have not been notified of the change.

Donations are processed through third-party payment providers. 5-2 Funding facilitates campaign tracking, reporting, and reconciliation. Funds are disbursed to the designated organization account. Service fees apply, and standard payment processing fees may apply. 5-2 Funding does not operate as a bank or escrow agent.

We provide tools and managed services designed to improve fundraising performance; however, no guarantees are made regarding funds raised or campaign outcomes.

Fundraising Goals and Goal Adjustments

Fundraising goals displayed through the 5-2 Funding platform may be established by the participating organization and may be adjusted during the course of a fundraising campaign. The platform may automatically increase a displayed fundraising goal based on campaign performance, including amounts raised and progress toward the then-current goal.

Automatic goal adjustments are intended to encourage continued participation and maintain fundraising momentum. An adjusted goal does not reduce, limit, or otherwise alter amounts previously raised, and a displayed fundraising goal should not be interpreted as a maximum amount that an organization may raise or as a representation that fundraising will cease once the displayed goal has been reached.

When a fundraising goal has been automatically increased by the platform, the updated goal will be identified on the donation page as an “Adjusted Goal.”

All platform systems, content, branding, messaging systems, and operational processes remain the property of 5-2 Funding and may not be copied, reproduced, or distributed without prior written permission.

To the fullest extent permitted by law, 5-2 Funding shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Services. Total liability shall not exceed fees paid to the Company.

You agree to indemnify and hold harmless 5-2 Funding from any claims, liabilities, damages, losses, or expenses arising from your use of the Services, violation of laws, failure to obtain proper consent, or misuse of data.

We may suspend or terminate access to the Services at any time for violations of these Terms, suspected misuse, unlawful activity, or actions that may expose 5-2 Funding to liability or reputational harm.

If an organization enters into a separate written service agreement with 5-2 Funding, the terms of that agreement will govern in the event of any inconsistency with these Terms of Service.

These Terms are governed by the laws of the State of Texas.
