By accessing or using the services provided by 5-2 Funding (“Company,” “we,” “us,” or “our”), including our platform, managed fundraising services, and related tools (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

5-2 Funding provides a fundraising platform combined with a managed service, including campaign setup, participant onboarding support, SMS and email communications, live fundraising event execution, donation tracking and reporting, ongoing campaign monitoring, donor support, and donation reconciliation and disbursement coordination. We may act on behalf of organizations to execute fundraising activities.

You agree to provide accurate and complete information, maintain rights to all data submitted (including contact lists), obtain all required permissions and consents from participants and contacts, and use the Services only for lawful purposes. You are solely responsible for compliance with applicable communication and privacy laws.

By using the Services, you represent and warrant that you have obtained prior express consent from individuals before submitting their contact information and that you authorize 5-2 Funding to send SMS, email, and related communications on your behalf. Message frequency may vary. Message and data rates may apply. Recipients may opt out at any time. 5-2 Funding is not responsible for consent obtained improperly.

Donations are processed through third-party payment providers. 5-2 Funding facilitates campaign tracking, reporting, and reconciliation. Funds are disbursed to the designated organization account. Service fees apply, and standard payment processing fees may apply. 5-2 Funding does not operate as a bank or escrow agent.

We provide tools and managed services designed to improve fundraising performance; however, no guarantees are made regarding funds raised or campaign outcomes.

All platform systems, content, and processes remain the property of 5-2 Funding and may not be copied or distributed without permission.

To the fullest extent permitted by law, 5-2 Funding shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed fees paid to the Company.

You agree to indemnify and hold harmless 5-2 Funding from any claims arising from your use of the Services, violation of laws, failure to obtain proper consent, or misuse of data.

We may suspend or terminate access at any time for violations of these Terms or suspected misuse.

If an organization enters into a separate written service agreement with 5-2 Funding, the terms of that agreement will govern in the event of any inconsistency with these Terms of Service.

These Terms are governed by the laws of the State of Texas.
